Major Legal Victory in the Evolution of the BNC Case. The Port-au-Prince Court of Appeal rules that, due to their status as president, Emmanuel Vertilaire, Smith Augustin, and Louis Gérald Gilles cannot be prosecuted before ordinary courts. A decision rendered this afternoon, February 19, 2025.

It will be forwarded as a definitive indictment by the public prosecutor's office of the capital's court of first instance to investigating judge Benjamin Félismé. The magistrate will then have to acknowledge his lack of jurisdiction in handling the BNC case.
